Terms of Service, Refund & Chargeback Policy

Subscription Design Services

These Terms govern all subscription-based services provided by Delineation Ink (“Designer”, “we”, “us”) and apply to all payments processed via Paystack. By subscribing, you (“Client”, “you”) agree to these Terms.

1. Nature of Subscription Services

Delineation Ink provides on-demand design services on a subscription basis.
Subscriptions grant access to time, availability, and professional capacity, not guaranteed outputs, deliverables, or results.

Work is performed based on submitted briefs and available subscription hours.

2. Billing & Payments (Paystack)

• Subscription fees are billed monthly in advance

• Payments are processed securely via Paystack

• Subscriptions auto-renew unless cancelled before the next billing date

• You authorise Delineation Ink to charge your selected payment method for each billing cycle

Delineation Ink does not store card or banking details.

3. Use of Subscription Hours

• Hours refresh monthly according to your plan

• Unused hours may roll over only if your plan explicitly allows it

• Hours have no monetary or resale value

• Hours cannot be exchanged for cash, transferred, or refunded

• Hour usage is tracked internally and may be used as billing evidence

4. Refund Policy (Paystack-Compatible)

No Refunds on Active Subscription Periods

Once a billing cycle has started, subscription fees are non-refundable, including:

• Unused or partially used hours

• Early cancellation

• Changes in Client priorities, staffing, or strategy

This reflects the fact that subscription fees secure reserved capacity, which Paystack recognises as a valid digital service model.

5. CPA & Legitimate Refund Exceptions

Nothing in this policy limits your rights under the Consumer Protection Act 68 of 2008 (South Africa).

A pro-rata refund may be issued only if:

• Services were not rendered at all, or

• Services were materially defective due to Designer’s failure

Refunds are calculated based on hours actually used, logged, or made available.

6. Cancellation

• Subscriptions may be cancelled at any time in writing

• Cancellation takes effect at the end of the current billing cycle

• No penalties apply

• No refunds are issued for the active billing period

• Unused hours expire per the subscription terms

7. Chargebacks & Paystack Disputes

Important

Before initiating a chargeback, you agree to contact Delineation Ink to resolve the issue directly.

Initiating a chargeback without first attempting resolution may be treated as a contractual breach.

In the event of a Paystack dispute or chargeback:

• We will submit evidence including:

  • This policy

  • Proof of subscription acceptance

  • Usage logs

  • Communication records

  • Time availability records

• Services may be paused immediately during the dispute process

• Any fees, penalties, or losses incurred due to an unjustified chargeback may be recoverable

Paystack’s decision is final and binding for payment processing purposes.

8. Digital Services Acknowledgement

By subscribing, you acknowledge that:

• The service is digital and time-based

• Availability begins immediately upon billing

• Value is delivered through access and readiness, not only completed work

• This model is recognised by Paystack as a valid non-refundable service when clearly disclosed

9. Intellectual Property

Upon full payment:

• You receive a perpetual licence to use final deliverables created during the subscription

• Delineation Ink retains ownership of tools, drafts, methods, and working files unless agreed otherwise in writing

10. Limitation of Liability

To the fullest extent permitted by law:

• Delineation Ink is not liable for indirect or consequential damages

• Total liability is limited to the amount paid in the most recent billing cycle

This does not exclude liability that cannot be limited under South African law.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
Disputes fall under South African jurisdiction.
